# TERMS AND CONDITIONS ## INTRODUCTION ### 1.1 Binding Agreement These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("Bidder," "Buyer," or "you") and Bid Boss Inc. ("Bid Boss," "we," "us," or "our"). These Terms govern your registration, bidding, purchase of lots, payment, pickup, shipping, and any related services provided through the Bid Boss auction platform. By registering, placing a bid, or purchasing any lot, you confirm that you have read, understood, and agree to be bound by these Terms in full. ### 1.2 Incorporated Policies All supplementary policies referenced herein, including but not limited to the Privacy Policy, Shipping Policy, and auction-specific rules, are incorporated by reference and form part of these Terms. In the event of any conflict, these Terms prevail unless expressly stated otherwise in writing. ## ELIGIBILITY AND REGISTRATION ### 2.1 Eligibility You must be at least eighteen (18) years of age and have full legal capacity to enter into binding contracts. By registering, you represent and warrant that you meet these requirements. ### 2.2 Account Information You agree to provide true, accurate, and complete information during registration, including your legal name, address, email address, and contact details. You are responsible for maintaining accurate and current information. Failure to do so may result in suspension or termination of your account. ### 2.3 Account Security You are solely responsible for all activity conducted through your account and for safeguarding your login credentials. Bid Boss is not liable for unauthorized use resulting from your failure to maintain account security. ## COMMUNICATIONS AND NOTICES ### 3.1 Electronic Communications By registering, you consent to receive communications from Bid Boss via email, telephone, or SMS related to auctions, invoices, pickup scheduling, policy updates, and other transactional matters. ### 3.2 Marketing Communications You may opt out of marketing communications at any time. Transactional and legal notices are mandatory and cannot be opted out of. ### 3.3 Official Notice Official correspondence must be submitted in writing to [info@bidbossinc.ca](mailto:info@bidbossinc.ca) for general inquiries and to [support@bidbossinc.ca](mailto:support@bidbossinc.ca) for support and returns. Notices sent to your registered email address are deemed received twenty-four (24) hours after transmission. ## AUCTION CONDUCT AND BIDDING ### 4.1 Binding Bids All bids are firm, irrevocable offers to purchase. Bids cannot be cancelled, retracted, or modified for any reason. ### 4.2 As-Is Sales with Limited Functional Coverage All lots are sold "AS IS, WHERE IS." Bid Boss provides limited post-sale coverage for major functional defects or Item Not As Described (INAD) issues only, and only for Grade A and Grade B items. Missing parts, accessories, manuals, packaging, cosmetic issues, wear, or completeness are excluded unless expressly stated in the lot description. For pickup orders, claims must be submitted within twenty-four (24) hours of pickup. For shipped orders, claims must be submitted within twenty-four (24) hours of confirmed delivery. For shipped items, the buyer is responsible for return shipping costs using a trackable method approved by Bid Boss. All Grade C and Grade D items are final sale and are not eligible for claims, returns, or refunds. ### 4.3 Bidder Due Diligence You are solely responsible for reviewing all descriptions, photographs, condition grades, and disclosures prior to bidding. Failure to inspect or verify condition is entirely at your own risk. Bid Boss receives truckload inventory on a continuous basis. Each item is individually inspected, graded, and photographed by Bid Boss staff. Each lot includes a title, an estimated MSRP where available, stock images generated from the original retailer when applicable, and one or more real images of the actual item. Descriptions include the full title, grading condition, and any relevant notes. Buyers are strongly encouraged to review all images and read the entire description prior to bidding. Bidder remorse is not permitted. Any questions regarding a specific lot must be submitted using the "Contact Auctioneer" button before bidding. ### 4.4 Auctioneer Discretion Bid Boss and its auction platform reserve the absolute right to reject bids, withdraw lots, extend or cancel auctions, resolve disputes, or disqualify bidders. All such decisions are final and non-appealable. ### 4.5 Technical Issues Bid notifications are system-generated and not guaranteed. Bid Boss is not liable for missed bids, delayed alerts, or technical interruptions. ## PAYMENT AND INVOICING ### 5.1 Settlement Invoice Following auction close, Bid Boss will issue an invoice detailing hammer prices, buyer's premium, handling fees, applicable taxes, and shipping charges where applicable. ### 5.2 Accepted Payment Methods Payment is due
