These updates are intended to better define the rights and responsibilities of both the Auctioneer and our bidders, reduce misunderstandings, and provide clear procedures for resolving legitimate issues while protecting the integrity of the auction process. Nothing in these updates is intended to limit any non-waivable rights afforded under applicable law. Diamond K Armory has updated its Bidder Terms & Conditions. By registering for and bidding in this auction, you acknowledge that you have read, understand, and agree to the current Terms & Conditions in their entirety. Recent Policy Updates Include: Auction Procedures Auctioneer may add, withdraw, combine, divide, substitute, edit, or correct lots, descriptions, photographs, reserve status, quantities, or other auction information prior to a lot closing. Auctioneer reserves the right to cancel a sale or withdraw a lot prior to transfer if an item becomes unavailable, is listed in error, cannot legally be transferred, or completion of the transaction would violate applicable law or these Terms. Diamond K Armory does not regularly conduct fully absolute auctions. The absence of a "Reserve Not Met" or similar indicator does not mean a lot is being sold without reserve. Bidding Bidders are solely responsible for every bid placed through their HiBid account. Requests to retract or modify bids must be made before the applicable lot closes and are subject to Auctioneer approval. Bidders are responsible for monitoring their email, phone, and HiBid account. Failure to receive or review communications does not relieve any contractual obligation. Payment & Defaults Payment is due immediately upon receipt of the invoice. Declined payment methods do not extend payment deadlines. Check payment procedures, deadlines, and tracking requirements have been clarified. Default remedies have been expanded, including liability for resale deficiencies, administrative expenses, collection costs, court costs, and attorney's fees where permitted by law. Acceptance of late or partial payment does not waive any contractual rights or remedies. Chargebacks & Disputes Any issues regarding item condition or discrepancies must be reported within 48 hours of delivery. Bidders agree to cooperate in good faith with any reasonable resolution offered before initiating a chargeback or payment dispute. Initiating an unjustified chargeback constitutes a breach of the Terms & Conditions. Shipping, Transfers & Storage Items must be picked up, shipped, or transfer arrangements initiated within 21 days of auction close. Storage fees, abandonment policies, shipping timeframes, NFA requirements, returned shipment procedures, and receiving FFL responsibilities have been expanded and clarified. Order-In Item availability and fulfillment policies have been updated. Mystery Lots & Promotions Mystery Lot policies have been expanded to clarify risk, estimated values, promotional images, and buyer assumptions. Official policies governing Golden Tickets, giveaways, and promotional events have been added. Additional Legal & Administrative Updates Added provisions regarding fraud prevention, electronic records, electronic acceptance, compliance with applicable law, governing law and venue, force majeure, entire agreement, additional lot-specific terms, and other administrative clarifications. These revisions are intended to improve transparency, clarify bidder responsibilities, and ensure a fair and efficient auction process for all participants.
